The domain airnewzealand.nl to be transferred to Complainant Air New Zealand Ltd. of Auckland, New Zealand
It is New Zealand’s national carrier and part of international “Star Alliance” airline network, whose international advertising material refers to “Air New Zealand”.
They have large portfolio of trademarks, including trademark registrations for the European Community, which are also valid in the Netherlands:
It had filed a complaint in WIPO against Kan of Glenside, Wellington, New Zealand for domain name <airnewzealand.nl>
The WIPO Panel observed that
1. Domain Name is confusingly similar to Complainant’s AIR NEW ZEALAND word and device mark.
2. The Respondent failed to produce any evidence to establish its rights or legitimate interests in the disputed domain name.
3. The website under the Domain Name offers sponsored links of competitors of Complainant and also it is being offered for sale and hence the Domain Name was also considered as being used for commercial gain.
Given the above, the Panel holds that the Domain Name has been registered and is being used in bad faith
Based on the above mentioned observations the WIPO panel has ordered that the disputed domain name <airnewzealand.nl> be transferred to Complainant.
